Women's Health and Cancer Rights Act of 1998

Employers should be telling employees through an annual notice about the Women's Health and Cancer Rights Act of 1998.  In accordance with this law, health insures ofering mascectomy coverage must also provide coverage for reconsctructive surgery in a manner determined in consultation with the attending physicians and the patient.

This law applies to fully insured plans, self-insured group and non-group plans that began on or after October 21, 1998.   For group health plans, the notice must be delivered in accordance with the DOL's disclosure regulations applicable to furnishing Summary Plan Descriptions.
